Is it legal to install surveillance cameras at the front door?

Outdoor video surveillance cameras are an effective way to deter burglars and keep your home secure. However, there are certain limitations that should be taken into account when installing one of these home security solutions. 

Regulations on the installation of security cameras in the home 

Current law does not prohibit the installation of security cameras inside the property. However, if the outdoor video surveillance camera is placed at the door of the property, certain requirements must be met. 

The device (e.g., an outdoor surveillance camera that can be viewed from a mobile phone) must be pointed towards the property itself. In other words, a camera cannot be placed in such a way that its angle of view includes common areas with neighbours, public roads or adjacent properties. 

Furthermore, in compliance with the Organic Law on Data Protection (LOPDGDD), it will be mandatory to place a sign informing of the presence of these outdoor video surveillance cameras. And, if these security systems have the capacity to store images, they may only be used for security purposes (such as evidence for a complaint) and stored for a maximum of 30 days

What happens if the regulations are not complied with? 

Failure to comply with data protection regulations has legal consequences, even if it involves installing security cameras in your own home. Individuals affected by recordings made outside the scope of current legislation may demand the deletion of such material and even take legal action against the owner of the camera. 

The Spanish Data Protection Agency (AEPD) may also impose penalties and demand compensation for personal injury caused. Fines for outdoor video surveillance cameras with a 360º angle usually range from £500 to £1,300 but may be much higher depending on the particular characteristics of each case.
